  1. PLASTOCK CD USER AGREEMENT

  3. This is a legal agreement between Photonica/Amana and the user of
  4. this CD-ROM.  By opening this package and or using this CD-ROM
  5. (hereafter "CD"), you agree to be bound by the terms of this
  6. agreement.  If you do not agree,  you may not use this CD for any
  7. purpose and must return the CD and the Photonica/Amana CSA
  8. Plastock Catalog #40  to your nearest Photonica agent. This CD
  9. and the images contained therein are protected by copyright. The
  10. CD and the images therein are licensed and not sold.

  12. Photonica/Amana grants to you, and your employer if you are
  13. licensing on behalf of your employer, a revocable, non-exclusive,
  14. non-transferable right to use the low resolution  images provided
  15. on this CD for one time  client presentation purposes only.
  16. Copying the images or this disc for any other purposes is
  17. unlawful and is strictly prohibited.  The images may not be used
  18. in print or TV advertising or marketing materials or in any
  19. online or electronic distribution system including duplicate CDs,
  20. disks, or the Internet.  The images may not be distributed,
  21. sublicensed, transferred or made available for use or
  22. distribution, and no rights may be granted to the images.  Except
  23. for the limited rights granted to use these Low Resolution images
  24. for one time client presentation purposes, rights to use the
  25. images contained on this CD  in high resolution or low resolution
  26. must be obtained from Photonica/Amana in writing prior to each
  27. use.  The images, software, and disc may not be used in creating
  28. a disc library or in an image storage device or network
  29. configuration of any kind.  ALL IMPLIED WARRANTIES OF
  30. MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE ARE
  31. SPECIFICALLY EXCLUDED AND DISCLAIMED. NEITHER PHOTONICA/AMANA NOR
  32. CSA ARCHIVE SHALL BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY
  33. FOR ANY GENERAL, SPECIAL, DIRECT, INDIRECT, CONSEQUENTIAL OR
  34. INCIDENTAL OR OTHER DAMAGES ARISING OUT OF THIS LICENSE OR
  35. OTHERWISE.  All rights to the images, software on the  CD are
  36. owned by either  Photonica/Amana or CSA Archive  and are
  37. protected by United States copyright laws, international treaty
  38. provisions and other applicable laws.  Photonica/Amana or CSA
  39. Archive retain all rights not expressly granted by this
  40. agreement.  At the sole discretion of Photonica/Amana or CSA
  41. Archive any or all of the images contained on this CD may be
  42. discontinued or be replaced with an alternative at any time
  43. without prior notice and the rights that may be granted to use
  44. either a high resolution or low resolution version of any or all
  45. of the images contained on this CD or in the Photonica/ Amana CSA
  46. Plastock Catalog #40  may be revoked. Upon notice of any
  47. discontinuance of a license for a particular image, you or your
  48. employer, and your client if applicable, agree not to use the
  49. image in the future. Your use of this material constitutes
  50. acknowledgement and agreement to the above terms.
